Bina Patel


Bina has extensive experience in dealing with all aspects of employment law and related matters. She acts for both employers and senior executives across various sectors in providing advice and dealing with disputes. Bina is a strong litigator and regularly deals with claims in the Employment Tribunal, including claims for unfair dismissal, whistleblowing, discrimination, sexual harassment, victimisation, equal pay, unlawful deduction of wages, and part-time workers’ discrimination, as well as claims in the High Court including in respect of breach of contract and disputes involving post termination restrictions.

Her advisory work for employers includes advice on dealing with grievance and disciplinary matters, sickness absences and capability procedures, performance management, redundancies and reorganisations, business protection and restrictive covenants issues, terminations of employment, contracts, staff handbooks and policies as well as day to day HR advice.

For executives, in addition to the above matters, she regularly advises on employment contracts and consultancy agreements, managing exits and negotiates valuable termination packages as well as large financial settlements in litigation.

Bina particularly enjoys the personal nature of working closely with both senior executive and employer clients and developing good working relationships, finding commercial and practical solutions for clients and maximising and achieving the best results for them.

Examples of recent work:

Bina recently secured a great result for an employer client in settling employment tribunal proceedings involving multiple claims by persuading the Claimant to withdraw his claims in exchange for agreeing not to pursue the Claimant for costs.

She also acted for a leading market research company and was successful in obtaining suitable undertakings and a settlement sum from an ex-employee in respect of his misuse of confidential information and breach of restrictive covenants – avoiding the substantial time and expense of injunction proceedings in the High Court.

She has also recently achieved a substantial financial settlement for a senior executive in respect of his whistleblowing claim and has successfully helped many senior executives to exit from their difficult employment situations (including where there was evidence of bullying, harassment and discrimination) and negotiating high value termination packages for them.

Bina worked with Jill Scott acting for the successful appellant in Prophet Plc v Huggett, a leading High Court and Court of Appeal case relating to the enforceability of post-termination restrictions

Bina trained at Archon and qualified as a solicitor in 2005. She is fluent in Gujarati.

She is a contributor to Termination of Employment (Bloomsbury) and is a member of the Employment Lawyers Association, the Industrial Law Society, the Society of Asian Lawyers, the Association of Asian Women Lawyers and the Women in Business Network.

She enjoys travelling far and wide, cycling, yoga, football and poker.
