Rob McCreath

Experience:

Rob enjoys using his depth of experience of employment law and related issues to help clients deal with difficult workplace problems. He combines strong technical expertise with a pragmatic, hands-on approach. He acts for both employers and senior executives in a wide range of sectors including higher and further education, luxury brands, media, technology, professional services and charities.

He advises clients on all employment and related issues, including restructurings and redundancies; senior exits; transfers of business and service provision changes under TUPE; discrimination-related claims and governance issues.

Rob is a CEDR-accredited mediator and acts as an independent mediator in relation to employment and related disputes.

Examples of recent work:

For a City-based professional services firm, securing an agreement under which two partners who had left to set up in competition disclosed all their dealings with clients and contacts of our client since leaving, gave formal undertakings to our client and the Court to desist from further dealings for a specified period and made a substantial contribution to our client’s costs.

Securing a settlement for a large employer in relation to a complex age discrimination claim from a senior employee who had been made redundant, including dealing with high value pensions issues. The claim was settled for a small fraction of the total potential liability. Dealing with the case required detailed knowledge of the relevant pension arrangements, a detailed understanding of the criteria and other reasons behind the redundancy selection process and a tough approach towards litigation and negotiation.

Adult Learning Inspectorate & others v Beloff & others: an Employment Appeal Tribunal case relating to redundancies and transfers of businesses under TUPE, particularly with regard to consultation

Argyll Coastal Services Ltd & others v Stirling & others: an Employment Appeal Tribunal case relating to service provision changes under TUPE, including whether there is a group of employees which has been established to carry out the relevant activities
